ARTICLE 1: ACCEPTANCE OF TERMS

By accessing or using IcyKit (the "Platform"), provided by Nicolas Virin ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Platform.

These terms constitute a legally binding agreement between you and the Platform owner. Usage of the Platform implies full understanding and absolute acceptance of these articles.

ARTICLE 2: SERVICE DESCRIPTION & ELIGIBILITY

IcyKit is an AI-powered video creation studio designed to assist creators in generating faceless video content. You must be at least 18 years old or the age of majority in your jurisdiction to use this service. By using the Platform, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.

ARTICLE 3: INTELLECTUAL PROPERTY

Platform Ownership: All rights, title, and interest in and to the Platform (excluding content provided by users), including its design, source code, algorithms, AI models, and branding, are and will remain the exclusive property of Nicolas Virin.

User License: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Platform strictly for your personal or commercial video creation purposes, subject to these terms.

ARTICLE 4: USER CONTENT & CONDUCT

You are solely responsible for the content you generate or upload using the Platform. You represent that you own or have the necessary rights to use such content.

By using the Platform, you agree NEVER to produce content that is:

Illegal, harmful, or promotes violence/terrorism.
Infringes upon the intellectual property rights of third parties.
Deceptive, fraudulent, or impersonates others without authorization.

ARTICLE 5: DISCLAIMER OF RESULTS & EARNINGS IcyKit provides tools and guidance for video creation. However, WE DO NOT GUARANTEE any specific results, including but not limited to: YouTube views, subscriber growth, monetization approval, or financial earnings. Success in content creation depends on numerous external factors beyond our control. Any "case studies" or "examples" shown are for illustrative purposes only and do not represent a guarantee of your future performance.

ARTICLE 6: LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICOLAS VIRIN AND ICYKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM.
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM.
ANY CONTENT OBTAINED FROM THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO ICYKIT IN THE LAST SIX MONTHS.

ARTICLE 7: INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Nicolas Virin from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

ARTICLE 8: GOVERNING LAW & JURISDICTION

These terms shall be governed by and construed in accordance with the laws of the jurisdiction where the Platform owner resides, without regard to its conflict of law principles. Any legal action or proceeding arising under these terms will be brought exclusively in the courts located in that jurisdiction.

ARTICLE 9: MODIFICATIONS TO SERVICE

We reserve the right to modify or discontinue, temporarily or permanently, the Platform or any features or portions thereof without prior notice. You agree that we will not be liable for any modification, suspension, or discontinuance of the Platform.
